Plaintiffs allege in their Complaint that Defendants misclassify assistant store managers who worked the night or graveyard shift as exempt, in violation of California’s wage and hour laws, and thus routinely deny employees like Plaintiffs and the Class their statutorily-mandated rights. Defendants removed the case to Federal Court and the matter is pending in the United States District Court for the Northern District of California. The parties are currently engaging in the discovery process.
The Court denied class certification of Plaintiffs' claims.
The parties subsequently settled their remaining individual claims.
